How Does a Dissolution of Marriage Work?

Dissolution of Marriage is a process in which a married couple reaches an agreement on all of the issues between them. Once the agreement is complete, they file a copy of the agreement along with a petition for dissolution of marriage with the court. The court sets the case for a hearing approximately 6 weeks later. At the hearing, the court will ask both spouses to confirm that they are still in agreement. If they are, and if the court is satisfied that there are no other issues, the marriage is dissolved and the agreement is ordered into effect.

The issues that you and your spouse will need to reach agreement on include:

  • Division of assets: bank accounts, retirement accounts, real estate, personal property
  • Division of debts: credit cards, loans, mortgages, taxes
  • Spousal support: how much and how long
  • Business interests: ownership or buyout of family businesses
  • Attorney fees and court costs
