Murder charges dropped against Akron brothers after data-tracking firm can't supply records

Two Akron brothers had their murder charges dismissed Monday after Global Intelligence Inc. — the parent company of an internet and cell phone data tracking software called CyberCheck — could not provide records in a joint request issued by prosecutors and defense attorneys.


"Without those items, the state cannot satisfy the Daubert standards," Summit County Assistant Prosecutor Rick Raley said Monday, referring to a hearing used to determine the credibility of testimony.


Without evidence to convict the brothers, Summit County Common Pleas Court Judge Kathryn Michael dismissed those charges without prejudice.


"These cases could be refiled" if new evidence comes to light, Michael noted.


Attorneys Noah Munyer and Jeff Laybourne represented Demonte Carr. Attorney Reid Yoder represented Demetrius Carr.


"We appreciate the prosecutor’s office following the evidence and dismissing the case against Mr. Carr," Munyer said. "Mr. Carr and his family are grateful to have this matter behind them."
